A) A newly acquired dependent may be added to COBRA the same as a newly acquired dependent may be added to an active employee’s coverage. The newly acquired dependent must meet the same eligibility requirements and be enrolled timely just like a non-COBRA member.
Q) Can a COBRA member make changes during open enrollment?
A) If an employer has an open enrollment period while an employee is covered through COBRA, the plan must allow the person on COBRA to take advantage of the open enrollment period to the same extent as the non-COBRA plan members. Therefore, if an active employee could add additional coverage during annual enrollment period, so can the person covered through COBRA.
