Our Agency has less than 50 employees. Do we need to file 1094/1095 forms?

Yes, all of the agencies on the state plan are self-insured, so your agency is required to file regardless of size. Employers with less than 50 employees need to complete the 1094-B (IRS form) and 1095-B (employee) forms. Employers with more than 50 employees need to complete the 1094-C (IRS form) and 1095-C (employee) forms.

Note: If you file 250 or more Forms 1095-B or Forms 1095-C, you must electronically file them with the IRS.
