After a divorce, ex-spouses and stepchildren are no longer eligible to continue on the benefit plans.
Following a divorce, you must update your insurance benefits. You must notify your agency benefits coordinator or Benefits Administration about the divorce. This must be done as soon as the divorce is final and no later than 60 days after entry of the final order/decree. Failure to report a final divorce order constitutes misrepresentation of dependent eligibility, and also results in waiver of COBRA continuation benefits for the ex-spouse and step-children. . To remove your ex-spouse and/or stepchildren from your benefits, you must submit:
- A completed Insurance Cancel Request Application (found here: Cancel Request Application), AND
- The entire final divorce decree signed by the judge. Note: All pages of the final divorce decree must be submitted.
Do not submit a request to terminate coverage of a dependent spouse or stepchild while a divorce case is pending, without seeking advice from your attorney. It is your responsibility to make sure the request to terminate a dependent spouse or stepchildren while a divorce is pending meets all legal requirements. Benefits Administration will not re-enroll the removed ex-spouse or step children if you later discover that you made a mistake.
